Police didn’t find any synthetic marijuana at McCloud’z or Fatt Hedz, court records show, unlike a March 24 multi-agency raid at Mr.Coolz in Oklahoma City, in which thousands of packages of synthetic marijuana were seized and the owners were accused of money laundering.Ziggyz Smoke Shop in Oklahoma City in April also was raided, but the U.S.attorney’s of‌fice declined to release documents or details on that operation.At Fatt Hedz and McCloud’z, police seized glass pipes, vaporizers, rolling papers, scales and accessories like Frisbees, pens and hats, according to search warrants filed in Oklahoma and Cleveland counties.At the Oklahoma City Fatt Hedz, police also seized a sign that read: “All of our products are intended for tobacco use only.If we suspect that you intend to use our products for illegal substances, or if you use improper terminology we will refuse to sell to you and you will be directed to leave the premises IMMEDIATELY.” Retailers often believe disclaimer signs such as these keep them on the right side of the law, but it’s not always the case.

State law lists a litany of items that can be considered drug paraphernalia, including metal, wooden, glass or plastic pipes; water pipes; miniature spoons; carburetion tubes and masks.Even something like a copper scouring pad can be considered drug paraphernalia depending on the context, explained Mark Woodward, a spokesman for the Oklahoma Bureau of Narcotics and Dangerous Drugs Control.According to state law, an item can be classified as drug paraphernalia if it contains drug residue, is found in close proximity to drugs or if a conversation about the item references drugs.“In a very cavalier type of way, they are advertising the sale of what they think are legitimate products because they don’t actually contain marijuana, but they are selling them with full knowledge that they are going to take these products and use them to ingest marijuana.That’s where it crosses into a criminal of‌fense,” said Travis White, an attorney for the bureau.Working undercover, Norman police detective Rick Newell visited the Fatt Hedz in Norman three times and spent nearly $600 on merchandise before initiating the Oct.

22 bust, court records show.During the visits, Newell asked store employees about “kief” boxes, vaporizers and a baseball cap with a marijuana leaf on it.He referenced drugs using the slang terms “kief, dab, hash, THC and butter.” While police were at the store serving the warrant, store owner Brandon Chandler told detective Newell he was going against a Supreme Court ruling, and Newell responded that he was acting under state law.Chandler pointed out the “tobacco use only” signs, court records show.“I explained to Chandler that he could have monkey signs up, but they don’t have any monkeys for sale inside,” Newell responded, according to the search warrant.Chandler asked Newell what would happen if he restocked the store, and Newell advised him not to do that.Chandler did not return two calls from The Oklahoman seeking comment.Chandler, 31, of Edmond, was charged April 17 in Cleveland County District Court with six counts of possession or selling paraphernalia in connection with a raid at the Campus Corner store — where more than 2,300 pipes of various sizes and materials were seized.

None of the items seized contained drug residue, and no illegal substances were found, court records show.Chandler also faces a charge of possession of drug paraphernalia and illegal possession of drug proceeds in Oklahoma County District Court in connection with a similar raid on Dec.9 at his Oklahoma City store, where more than 1,200 pipes were confiscated.He has pleaded not guilty in the Oklahoma County case and hasn’t entered a plea to the Cleveland County charge.Tony Riddles, when asked why the Norman Police Department was initiating a raid outside of Norman, said an agent with the U.S.Of‌fice of Homeland Security assisted with the Oklahoma City raid.“We had the jurisdiction issue covered,” Riddles said.He wouldn’t say why Homeland Security was involved and neither would a Homeland Security spokesman.The Oklahoma County sherif‌f’s of‌fice accompanied Norman police to serve the search warrant but wasn’t involved in the investigation, he added.Riddles declined to elaborate on the raids because he said part of the investigation is ongoing.
